I. DEFINITIONS The terms used in this Policy shall have the following meanings:
1. LK-TRANS Sp. z o.o. with its registered office in Chełm, ul. Okszowska 41, registered in the National Court Register under KRS number 0000803668, company documents kept at the District Court Lublin-East in Lublin, branch in Świdnik, VI Commercial Division of the National Court Register, TAX ID (NIP) 563-243-95-95, REGON 384355381, share capital: PLN 10,000. Hereinafter "LK-TRANS".
2. LK-TRANS Liubomyr Kravchuk with its registered office in Chełm, ul. Okszowska 41, registered in the Central Register of Business Activity, TAX ID (NIP) 563-238-22-92, REGON 363354739. Hereinafter "LK-TRANS".
3. Service – this website operated and maintained by LK-TRANS Liubomyr Kravchuk under the domain https://lk-trans.eu.
4. Terms – the terms of use of the LK-TRANS Service (available e.g. at: https://lk-trans.eu/polityka-prywatnosci/).
5. User – any person using the Service.
II. GENERAL PROVISIONS
1. The purpose of these Terms is to define the conditions for the provision of services via the Service available at https://lk-trans.eu to the Users.
2. The User may, under the terms of these Terms, access the content made available in the Service and use the Service so as to have access to it at a time and place of their choosing, regardless of the type and method of operation of the device or application used by the User for that purpose.
3. A necessary condition for using the Service is the User's consent to be bound by the provisions of these Terms. By using the Service the User accepts the Terms and any changes thereto introduced by LK-TRANS.
4. The User confirms that they are of legal age and have full legal capacity to perform acts related to using the Service.
5. LK-TRANS is not liable for errors in published information, but takes all reasonable steps to ensure that information and images published on the Service are displayed correctly. Any display errors may result from incorrect settings of the User's computer or the device configuration not matching software requirements.
6. To the maximum extent permitted by law, LK-TRANS limits its liability to the User and shall not be liable for any damages or losses incurred by the User arising from or in any way connected — directly or indirectly — with the use of the Service, any transaction related to the use of the Service or disclosure of the User's data, except to the extent of non-excludable statutory rights.
7. LK-TRANS aims to ensure that the servers hosting the Service are free from computer viruses and other harmful software, but does not accept liability for any damage caused by computer viruses or harmful software introduced by third parties despite compliance with data security measures.
III. CONTENT OF THE SERVICE
1. The content and layout of the Service are protected by copyright, industrial property rights (including trademarks), database rights and other intellectual property laws under national law and international treaties. Copying, modifying, distributing or reproducing any content contained in the Service or the Service layout is prohibited.
2. All economic copyrights to works contained in the Service belong to LK-TRANS, which enjoys absolute protection under applicable law. The User declares that they acknowledge the copyrights, trademarks, patents and related rights connected with the materials posted, which constitute LK-TRANS property.
3. The User acknowledges that know-how, trademarks, logos and other signs or their specific compilations ("general trademarks") displayed in the Service are legally protected (regardless of registration) and none of the content posted in the Service shall be interpreted as granting any license to the User by LK-TRANS.
4. The User may use the Service and materials disseminated via the Service only within the scope of permitted use provided for by the copyright law and the law on database protection.
5. The technical data provided in the Service or other informational documents are indicative only and LK-TRANS does not guarantee their accuracy.
6. All applications, programs, layouts and other contents made available to the User in the course of using the Service are the property of LK-TRANS or entities related to LK-TRANS and their use (or any part thereof) other than viewing within the Service is prohibited. LK-TRANS provides them "as is" and is not liable for their proper functioning.
7. It is prohibited in any form or manner (without time limitation) to:
a) copy, transcribe, duplicate or otherwise reproduce any part of the Service content,
b) use, transfer, copy or reproduce any part of the Service (or its source code) except for the purpose of viewing the Service on the screen of the User's computer (or other device) or printing it for personal acquainting with the content,
c) distribute content contained on the Service,
d) modify, adapt or create derivative works of the content posted in the Service, as well as delete or destroy such content,
e) grant licenses or sublicenses in respect of the rights described above.
8. The information provided in the Service, including information about LK-TRANS products and their installation, is for informational purposes only.
9. Information published on the LK-TRANS Service, including materials published in LK-TRANS brochures, advertisements and other product publications, are indicative in nature and may change at any time. Such information does not constitute an offer within the meaning of the Civil Code even if it is accompanied by a price, but only an invitation to contact LK-TRANS. Product prices are specified in price lists made available by LK-TRANS and at its headquarters and branches and apply for the period indicated in the price list. For orders requiring special processing or cutting, the final price is set for a specific offer; if this price differs from the price list, the buyer must separately accept the changed price.
IV. LIMITATIONS OF LIABILITY
1. LK-TRANS provides the Service and related applications "as is" and does not guarantee their correct operation; the User uses the Service at their own risk and bears full responsibility for any damages (including losses or lost profits) resulting from downloading information from the Service and relying on information contained therein. LK-TRANS shall be liable only to the extent that mandatory applicable law does not permit exclusion of its liability.
2. LK-TRANS is not liable for consequences resulting from improper use of the Service content. LK-TRANS shall not be liable for indirect damages, consequential losses, business losses or lost profits related to the use and operation of the Service.
3. LK-TRANS, as well as telecommunications and network service providers for the Service, shall not be liable for damages arising from the use or inability to use the Service, nor for the accuracy, completeness, quality or suitability of the Service and its information for any purpose. The User hereby, to the maximum extent permitted by law, waives any claims in relation to the foregoing, whether based on contract, tort or otherwise.
4. LK-TRANS gives no warranties that the Service or the server hosting it are free from defects, including but not limited to viruses or other harmful elements.
V. COOKIES
1. LK-TRANS uses cookies ("cookies") on the Service — small text files stored on the User's terminal device (computer, phone, tablet).
2. LK-TRANS may collect data about the User's visit such as IP address, browser type, operating system, etc.
3. Cookies are used solely to provide better Service performance, in particular for:
a) adapting the Service to the User's needs and preferences,
b) smoother operation of the Service by maintaining the User session, temporarily remembering their settings and choices,
c) statistics — measuring popularity of functions and tabs.
4. Web browsers by default allow storing Cookies on the User's device, therefore by using the Service the User consents to the use of cookies.
5. By using the LK-TRANS Service, Users consent to the use of cookies. If the User does not consent to the use of cookies by LK-TRANS, they can block them in their browser settings.
6. The User has the right to block automatic storage of cookies by LK-TRANS by changing the settings in their web browser and configure cookie usage according to their needs.

VI. COMPLAINT PROCEDURE
1. Every User has the right to file a complaint regarding the functioning of the Service.
2. Complaints should be submitted electronically to: [email protected] or by mail to: LK-TRANS Liubomyr Kravchuk, ul. Okszowska 41, 22-100 Chełm.
3. The Provider will consider the complaint without undue delay, but not later than within 14 days from the date of its receipt.
4. The answer to the complaint will be sent to the User at the address provided by the User in the complaint.
5. The Provider reserves the right to extend the period referred to in point 3 above by no more than 10 days if handling the complaint requires unusual or exceptional actions or encounters obstacles beyond the Provider's control (hardware failures, internet outages, etc.). The Provider also reserves the right to request additional explanations from the User, in which case the time for the User to provide such explanations will extend the complaint handling period.
VII. FINAL PROVISIONS
1. The Service respects the privacy rights of its Users. Each User is bound by the current privacy policy, the text of which is posted at the address indicated above.
2. LK-TRANS strives to ensure that the information contained in the Service corresponds to the factual state, however it does not guarantee that no inaccuracies or discrepancies regarding products and their use may occur. Detailed product information requires careful review of LK-TRANS's offer.
3. All confidential information exchanged between a computer and the site https://lk-trans.eu/ is encrypted using SSL protocol. Please note that when accessing an external site from this Service, the Service has no control over third-party sites. Accordingly, the Service cannot guarantee that the operator of such site will treat Users' privacy in the same way as this Service does.
4. LK-TRANS reserves the right to temporarily suspend the operation of the Service, in particular for maintenance, repairs or implementation of improvements.
5. Content posted on the Service may not be republished elsewhere or in the media without LK-TRANS's consent.
6. The Terms and use of the Service are governed by the laws of the Republic of Poland. The User hereby agrees to the exclusive jurisdiction of the ordinary courts of the Republic of Poland for any disputes arising from or relating to the use of the Service. Use of the Service is prohibited in any jurisdiction that does not meet all the provisions of these Terms.
7. These Terms enter into force on 13 February 2023.
PERSONAL DATA PROTECTION
Information note on personal data at LK-TRANS
In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation, "GDPR"), we inform that:
1. Data Controller. The personal data controller is: LK-TRANS Liubomyr Kravchuk with its registered office in Chełm, ul. Okszowska 41, registered in the Central Register of Business Activity, TAX ID (NIP) 563-238-22-92, REGON 363354739 - hereinafter "Controller". 2. Processing of personal data.
a) Job candidates – the purpose of processing personal data is to conduct the recruitment process. Processing of candidates' personal data is based on their consent. Providing personal data is voluntary but failure to provide required data will make participation in the recruitment process impossible. Required data for recruitment: name, surname, address, educational background and employment history. Retention period: up to 6 months. If the candidate consents to participate in future recruitment, data may be stored up to 24 months.
b) Persons contacting LK-TRANS – the purpose is communication with persons contacting LK-TRANS. The legal basis is the Controller's legitimate interest in enabling communication and potentially establishing relations. Processed data: name, surname, e-mail address, phone number, correspondence address and other information provided by the contacting person. Providing data is voluntary, but without it communication may be hindered or impossible. Retention period for advisory, informational queries or newsletter subscription: until the person requests erasure or as long as necessary for legitimate interests. For complaints: until the complaint is resolved or until the warranty period for the purchased/complained product ends.
c) Contractors and their representatives – the purpose is to conclude and/or perform a contract. Processing is based on contract performance or the Controller's legitimate interest in enabling communication and contract execution. Processed data may include: name, surname, e-mail, phone, employer, position, business address, NIP, REGON, PESEL, and in some cases ID/passport details. Retention: duration of the contract and the period necessary to assert claims arising from it, but not shorter than statutory periods or as long as necessary for legitimate interests.
d) LK-TRANS guests – the purpose is identification and reception of guests on LK-TRANS premises and ensuring safety of people and property. Processing is based on the Controller's legitimate interest. Processed data: image (CCTV), name and surname. Retention: up to 3 months for CCTV recordings and up to 2 years for other data.
e) Participants in marketing projects (promotions, contests) – the purpose is communication with participants. Legal basis is the Controller's legitimate interest or the participant's consent. Processed data: name, surname, e-mail, phone, correspondence address and other provided information. Providing data is voluntary, but absence may prevent participation. Retention: until the completion of the promotion/contest or as long as necessary for legitimate interests.
3. Disclosure of personal data. Data may be disclosed to authorized bodies pursuant to law and to third parties such as LK-TRANS departments, technical and organizational service providers (e.g., IT providers) and legal or advisory service providers, who process data under contract and on Controller's instruction.
4. Automated decision-making. Personal data will not be processed by automated decision-making, including profiling.
5. Rights of the data subject:
- request access to personal data,
- request rectification of personal data,
- request deletion of personal data,
- request restriction of processing,
- object to processing,
- data portability,
- withdraw consent to processing (withdrawal does not affect the lawfulness of processing based on consent before its withdrawal),
- lodge a complaint with the supervisory authority (President of the Personal Data Protection Office).
6. Source of personal data
If personal data was obtained from sources other than the data subject, it means we received it from contractors, social media, the Internet or other publicly available sources.
